Sec. 66-151. Definitions.
(a) Shopping cart. A mobile device permanently set on four or less wheels, having storage capacity for up to 50 pounds or more, and having a handle or bar by which the device is pushed or maneuvered.
(b) Owner. Individual, partnership or corporation which owns the shopping cart, and offers the shopping cart for use to the customers of the owner's business establishment.
(c) Premises. The area provided by or to the owner of a shopping cart for automobile parking of his or its customers.

Sec. 66-152. Duties of owner of shopping carts.
(a) Identification. It shall be the responsibility of the owner of any shopping carts to insure that same bear permanently affixed identification showing the owner's name and business address within the village.
(b) Return of shopping carts. It shall be the responsibility of the owner of any shopping cart to take such action as is necessary to insure that all shopping carts are kept on such owner's premises or returned thereto by the owner or his agents and employees.
(c) Reclamation of shopping carts. It shall be the responsibility of the owner of any shopping cart to reclaim, in the manner provided hereafter, within five days after receiving written notice, any shopping cart which the village has removed from any public or private property, other than the premises of such owner.

Sec. 66-153. Removal of shopping carts from public or private property.
Any shopping carts found off the owner's premises shall be promptly removed there from by the owner of such shopping carts. Any shopping cart found on public property shall be deemed abandoned property. Any shopping cart located on private property, without the consent of the owner or lessee of such property, shall be deemed abandoned property. All such abandoned property which the village is required to remove from public property, or which the village is requested to remove from private property, shall be placed at a public storage area. All such abandoned property shall be disposed of by the village after giving the owner five days' previous written notice of intent to do so. Any owner who desires to reclaim such abandoned property shall first pay to the village a fee of $5.00 for each such shopping cart which the village is required to pick up and store in the manner hereinabove provided. Nothing herein shall require the village to take any action to identify the owner of any shopping cart which does not bear the identification required herein. The written notice of intent to dispose shall state the address where such shopping cart was found by the village.

Sec. 66-154. Removal of shopping carts from premises of owner.
It shall be unlawful for any person, firm or corporation to remove, maneuver or place a shopping cart beyond the boundaries of the premises of the owner of the shopping cart.

Sec. 66-155. Posting of article provisions.
The owner of any shopping cart or cart is required to post signs containing the provisions of this article on such owner's premises.

Sec. 66-156. Penalty.
Any person, firm or corporation violating any term or provision of this article shall be guilty of a violation hereunder, and upon conviction hereof shall be subject to a fine of not less than $10.00 nor more than $500.00, and each separate violation hereof shall be deemed a separate offense.
