8.18.020 Shopping Cart Identification Sign Required
A. Every shopping cart owned or used within the City shall have a shopping cart identification sign that is permanently affixed to that shopping cart.
B. It shall be the responsibility of each shopping cart owner or provider to provide the cart identification sign and to continuously maintain, or cause to be maintained, the shopping cart identification sign so all the required information is accurate and clearly legible.
C. It shall be unlawful for any person to possess a shopping cart without an accurate and legible shopping cart identification sign.
8.18.030 Physical Containment System Required
A. Every shopping cart provider shall install and maintain a physical containment system to the reasonable satisfaction of the Director of Community Development or his/her designee.
B. Prior to the issuance of a business license, each person conducting a new business which provides customers shopping carts must install a physical containment system pursuant to Subsection 8.18.3.A
C. Each person conducting an existing business operation which does not provide customers shopping carts prior to the effective date of this chapter must install a physical containment system pursuant to Subsection 8.18.3.A. prior to providing shopping carts.
D. Not later than six months after the effective date of this chapter, each person conducting any business which provides customers shopping carts must install a physical containment system pursuant to Subsection 8-18.3.A. The City Manager, in his sole discretion, may grant a six-month extension to this requirement.
8.18.040 Removal or Possession of Shopping Cart Unlawful.
A. It shall be unlawful for any person to remove or possess any shopping cart outside the business premises of the shopping cart’s owner or provider without the express prior written consent of that owner or provider.
B. It shall be unlawful for any person to authorize or permit the removal of a shopping cart from any business premises for any private use, except that removal in connection with the carts acquisition, maintenance, transfer of ownership or disposal is permitted.
8.18.050 Recovery of Unattended Carts
A. Any unattended shopping cart found outside the business premises of the shopping cart’s owner or provider and within the public right-of-way may be immediately removed by the City or its authorized agent upon the cart’s discovery.
B. For shopping carts having a shopping cart identification sign that are removed by the City, any owner, provider, or authorized cart retrieval service provider wishing to recover any such cart may appear during normal business hours at the City’s Maintenance Yard to retrieve the cart. Within five (5) days after said removal, the City shall notify the person listed on the shopping cart identification sign that the City has recovered the cart.
C. For shopping carts without a shopping cart identification sign that are removed by the City, any owner, provider or authorized cart retrieval service provider wishing to recover any such cart must furnish proof of ownership to the reasonable satisfaction of the Director of Public Works or his/her designee and appear during normal business hours at the City’s Maintenance Yard to retrieve the cart. Within five (5) days after said removal, the City shall notify either the owner or provider, if the identity of the owner or provider can be determined, that the City has recovered the cart.
8.16.060 Location of Removed Shopping Carts.
Any shopping cart removed by the City from the public right-of-way pursuant to this Chapter shall be taken to the City’s Maintenance Yard.
8.18.070 Destruction of Removed Shopping Carts.
The City may destroy or otherwise dispose of any shopping cart removed
